A person who wishes to remain in the United Kingdom as a dependant
of a person with a Student visa is able to switch in the UK.
As you are going to be married at the time of your application for dependant
visa you will need to provide your marriage certificate and your passports.
Evidence of co-habitation may not be necessary but may support
your application.
Before a person subject to immigration control will be able to give notice of a
marriage they will need to demonstrate to the registrars the written permission
of the Secretary of State will be granted in the form of a Certificate of Approval,
such as those that already exist for marriage.
In order to qualify for a certificate of approval applicants will normally need to have
been granted over six months leave in the United Kingdom and at least three
months of that leave must be remaining.
The application form required is: COA(M/CP) and is available on the IND website:
www.ind.homeoffice.gov.uk or by calling on 0870-241-0645. Applications have to be
made by post. A fee of £135 is payable. Public Enquiry Offices will not be able
to deal with certificate of approval applications.
Once you are married and your partner applies to extend his student visa using the FLR(S)
you may apply on the same application form as his dependant.
